The appellant sued to recover attorneys fees in the amount of $2,192.40 for services rendered to the defendant, whose answer admitted the amount owing and interposed two counterclaims for $3,287.30. The first counterclaim alleged, in effect, that the defendant sold goods to the Wisconsin Home Building Company in which the plaintiff was a partner and had represented he had authority to control the operation of the business; that the defendant had made sales in reliance on the fact the plaintiff was a partner and upon the assets and worth of the plaintiff and his apparent partnership; that the Wisconsin Home Building Company was engaged in developing a subdivision as a joint venture with the plaintiff, and that the plaintiff is indebted to the defendant for the materials furnished the Wisconsin Home Building Company in the amount of $3,287.30 with interest.
